3/22/2024: Association Successful in Foreclosure Action
We can now provide an update regarding a property within Buckhorn Preserve against which the Association initiated a Foreclosure Action. The property, located at 2615 Pankaw Lane, has been subject to various bank foreclosure activities since the passing of the owner, with no family stepping forward to take over responsibility for the property’s upkeep. Consequently, the property fell into a state of disrepair and became inhabited by suspected squatters. Despite appearances suggesting otherwise, the Association diligently enforced property upkeep by sending vendors to maintain items such as palms while the property remained vacant. However, upon becoming inhabited by the aforementioned “occupants,” who displayed significant hostility toward management employees and others attempting interaction, the Board of Directors promptly convened with the Association General Counsel to discuss the situation and explore legal options to enforce property standards and mitigate community issues.
Upon consultation, it was revealed that the mortgage foreclosures were progressing inefficiently due to the absence of responsible parties (heirs) and constant changes in mortgage instruments, necessitating the restart of the foreclosure process. In light of this, and acting on counsel’s advice, the Board opted not to wait for the mortgage foreclosure process to prolong further. Instead, they chose a more direct course of action by initiating foreclosure proceedings directly for unpaid assessments. This decision aimed to expedite the timeframe for assigning responsibility for property upkeep and, if necessary, evict any unauthorized occupants.
Today, the property was successfully sold to a third party, signaling the Association’s success in its foreclosure action and enabling it to recover all expenses and past due assessments. Due to pending litigation, the Association refrained from commenting on the matter. While foreclosure is always regrettable and something we aim to avoid, in this instance, given the absence of living heirs, it served as a positive tool to reestablish the ability to enforce property upkeep.
We are pleased that the property now has a new owner and anticipate working collaboratively to bring the lot back into compliance, acknowledging that this process may take time. We recognize the frustration that arises when it appears that nothing is being done, underscoring the importance of transparency at the earliest opportunity. The Board of Directors extends its gratitude to the community for their patience in this matter.
